I have had gout for several years and it
has caused me to take time off from work.
My family doctor filled out fmla forms to
give to my employer so that I would not be
fired for attendance due to the days
missed when gout flares up. My employer
denied me from acquiring fmla , stating
that gout does not qualify under the
family medical leave act. I do not wish
to lose my job but I am unable to work
when my gout flares. I do not know if my
employer is legally correct and if not
what should I do.
Please advise,

If you visit the department of labor's web
page it defines who is eligible for fmla
benefits. Specifically go to: http://www.Dol.Gov/esa/whd/fmla
/
if your employer has 50 or more employees
and you need time off for one of the
following:
for the birth and care of the newborn
child of the employee;
for placement with the employee of a son
or daughter for adoption or foster care;
to care for an immediate family member
(spouse, child, or parent) with a serious
health condition; or
to take
medical leave when the employee is unable
to work because of a serious health
condition.
if you qualify and your employer is
refusing to accept your claim, notify your
local labor board immediately. They can
make your employer comply as well as
direct you to the proper procedure to file
a claim for unfair labor practices.
Fortunately for me, my job was in a
cubical in an office and I did not have to
take time off work. My employer made
reasonable accommodations for me to keep
me on the job. Good luck with your
