I know I have mentioned before in previous posts that I was raped by erics brother. He has been in jail since may and is getting out december 30th. Does anyone know how long it takes to get a restraining order? Im going in to the womens resource center on monday to get an appointment to get one set up. I know that you have to get it approved by a judge and everything, so I dont htink he will get the papers until after he is out. I recently found out this, otherwise I would have done it already....

No but I got lotsa ofp's those are easy... Jsut go to the family center or something and file for one, any threats, violence and they cant come near u works wonders!

Its such a messed up situation, because its erics brother. He was really close to him before this happened, and now, eric despises him obviously. So its been tough.

Well, they dont talk about it, but I dont see his dad much. I see his mom all the time and she doesnt talk about it. But the day after it happened I told her everything because she came over after she heard about it. She was really supportive of me and she said she was disgusted. But I know she visits him in jail.

This is way late.... Lol...

But... I put a restraining order on my fob and they served it about 3 hrs after I filed it... Took me about 2hrs to file the whole thing...

Then you have to go to court about a week later to the final restraining order hearing (the inital order is called a tro- temporary restraining order)...

It also bars him from having anyone associated with him harass you on his behalf.

Sorry this is kinda late too .. Lol but I only just saw this ...

Usually if you can prove that there is an immidiate danger you xcan get an avo a lot faster than usual .. And in this case I am sure they would consider there enough of a threat to you to give you one fairly fast .. (im not sure it might be different where I am but I am pretty sure that's how it works.)

A friend of mine had a similar prob with a boy. In most states you can get a temporary restraining order in no time - you literally get it then and there at the courthouse. Then that gives you time to get a full restraining order. If he breaks either one of them you can get him put in jail.

There was a guy stalking me about a month ago, (hes like 65) he met me at my work (i was a waitress) and he kept coming in my work and sitting there, driving past my house, and calling my cell non stop. So I switched jobs and I was working at sears, and he was in there buying car parts one day and seen me, and he kept calling my work number and telling me he would be waiting by my car when I got off (at night) and he even started going to my moms house and saying "michelle told me to come here and get her schedule from you" so we called the cops, and the officer said we could get a ofp, but it wouldent do any good if he wanted to do something bad enough. He said ofp is a warning for them not to come around you. And if they do, you would call the deputy and they would have a talk with him. But they cant actually punish him without any proof. But he said if I got a restraining order, then if he did come within so many (feet?) of me, he would go to jail for violating the police orders or whatever. So I believe one is a warning to leave you alone, and the other is court ordered. From what the officer told me, but I dont know if its right...

Yeah an ro is similar to a criminal trespassing warning (except with an ro you are dealing with a person, not property)... If they cross the boundaries set forth in the document, you can call the police and they go to jail... A ro also covers phone calls, e mails, letters, etc.

An ofp is just a warning... That they know that if they do come near you etc that you will take further action.

Its usually used just to scare people (usually works) into leaving you alone.
