I am very scared that I might be pregnant and i'm not sure what to do.

My last period was on september 10th and I am currently taking orthotricyclen birth control pills. I was supposed to begin my new pill pack on the 18th of september but forgot until the 20th. I have read that the most common way to get pregnant while taking the pill is to forget to start the next pack- because your body goes for more than 7 days without hormones.

But, my boyfriend and I did not have intercourse. We were unsafe though. (maybe tmi) we were in a position that would have allowed for his precum to get on my vulva and then maybe on his hands before he put them in me.

So my question is- does the 5% or so "actual use failure rate" of birth control pills include instances where you forget to start your pill pack- and I guess is what my boyfriend and I did the equivalent of "withdraw" where there is a chance that some precum may have gotten into me. What are the odds of being pregnant?

For the last week I have had some symptons, nausea and freq. Urinating and strange cramps down low on my abdomen. But because I am still taking my pills i'm not expecting my period until october 11th. And waiting that long to test for pregnancy is going to kill me. I'll probably test on friday because then i'll be 12 dpo. Am I worrying myself sick or do I have legitimate reasons to be worried?

No, the 98% or whatever accuracy rate is when taken correctly.
If you do start a pack late, just use condoms for the next 7 days to be safe.
