Q: Pregnancy is Serious Physical Harm

This is utterly horrifying in and of itself, but it may have some relation to abortion:

Since rape charges don’t allow for such a long sentence, prosecutors are taking a different approach. They argue that pregnancy and childbirth for such a young girl is physical harm, the standard needed to seek a life sentence.

A Hamilton County grand jury today indicted Michael Chaffer, 40, on two charges of rape and a charge of felonious assault.

Chaffer is accused of raping the now 11-year-old Lincoln Heights girl many times when she was 10, from Sept. 8, 2006 to Nov. 4, 2007.

The girl’s mother remains under investigation, Deters said. “You know I have been doing this job probably too long, but every time you think you have seen it all, somebody like Michael Chaffer comes along and kind of clears the deck.

“This man is a beast who preyed on a 10-year-old,” he said.

Seeking a life prison term under the specification that pregnancy is serious physical harm is a first in Ohio.

Deters isn’t sure how it will play out in court, but said he believes the pregnancy meets the definition of serious physical harm. He said six other states consider child rape so aberrant it’s punishable by the death penalty.

The abuse to the girl began in September 2006 when the girl was 10, according to court records.

Chaffer threatened the girl, saying he would leave her mother if she told anyone, Deters said. Part of the investigation into the girl’s mother centers on whether the woman knew the abuse was happening.

Deters said the girl hid her pregnancy with big shirts. She was nearly nine-months pregnant when she complained of stomach pains Nov. 3. She was taken to University Hospital where she gave birth to a 4-pound baby girl the next day.

“When you hear her story it’s very upsetting,” Deters said. “It breaks your heart.”
The delivery set off an investigation by the Hamilton County Department of Job and Family Services.

While police looked for the infant’s father, social workers ordered the girl’s mother to keep all adult men away from the home, an order she broke by allowing Chaffer in the home, according to records.

When authorities discovered the mother’s deception, the girl and the infant were put into foster care, according to testimony from a previous dependency court hearing.

Prosecutors are seeking to permanently remove the infant from the girl’s care because the sixth-grade student is too young to care for the baby. A hearing in the case is set for next week.

Chaffer is currently in prison serving one-year prison term on an unrelated drug charge.

DNA testing has proved Chaffer is the infant’s father, Deters said.

That is just sad and twisted, that they have to use pregnancy as physical harm to make this guy pay. How about the mental harm which will take a long time if not a life time for this little girl to heal from? That's a whole other bag of worms for female equality. That the emotional and mental damage caused by rape is downplayed. Of course it's severe physical harm to a little girl to be pregnant. Just being penetrated by an adult male at that age would probably cause her scars that would never go away. This makes me sick to my stomach.

Yeah, really, you'd think that raping a ten year old repeatedly would be enough to give you life in prision. And you're right about the equality aspect, too.

that's so sad and wrong. The poor girl probably didn't have a clue what was going on to her body.

I agree with the mental/emotional damage of rape.

I agree with life in prison to any type of rape charge, reguardless of age.

That poor girl Crying or Very sad

I am going out on a limb since I havent read the case material but it seems that maybe they could get a harsher sentence on the perp if they included the incredible damage a pregnancy can do to a girl that age.. I need to lookup something fought about on another board pertaining to a doctor being excommunicated for performing an abortion on a 10 year old victim of child rape and incest.
There are serious health consequences to a child that age gestating.

Yes, that's what they are doing, since apparently just raping a ten year old won't give a harsh enough sentence. Ridiculous.

I agree.. I wanted the jail jacked up and the jerk thrown under.

and now the research: Factors influencing the effects of sexual abuse and keep in mind this is for a 11 year old little girl.

Earlier age at first pregnancy has been linked to lower bone density later in life. Accumulating data has shown that bone loss is more significant in pregnant, growing adolescent girls when compared with pregnant, adult women. In addition, breast-feeding adolescents experience more bone loss than breast-feeding adults.

Acutally some snooping around here shows that the girl had a 60% higher risk of death gestating the pregnancy then would a mature woman would.

Adolescent pregnancy is associated with higher rates of illness and death for both the mother and infant. Teenage girls are not only less ready than older women EMOTIONALLY to have a baby, they are less ready PHYSICALLY to have a health baby.

Pregnant teens are at much higher risk of having serious medical complications such as toxemia, pregnancy-induced hypertension, significant anemia, premature delivery, and/or placenta previa. The maternal death rate for mothers age 15 or younger is 60% greater than for women in their 20s.

Infants born to teens are 2-6 times more likely to have low birth weight than those born to mothers age 20 or older. Prematurity plays the greatest role in this, but intrauterine growth retardation (inadequate growth of the fetus during pregnancy) is also a factor.

I think if you factor in these issues there can be a case for an attempted 'homocide' charge on the rapist, that carries a harsher sentence then child rape does (depending on the state of course).

That man deserves life in maximum security prison!!!!!! How can you say ten to twenty is enough when there is a girl who might not ever trust another man in her life. The mental damage alone is enough, how can she go on knowing that someday this guy will be out on the street just looking for another girl to rape.

What the heck was the reason for that wisecrack? Are you so uneducated that you are unfamiliar with the very common phrase, "out on a limb"? Are you a child molester? Are you angry that Jincks thinks this scumbag needs to be severely punished?
