My ex is now requesting that a Paternity test be done because he is now questioning whether or not Reyna is his. This is so stupid! I am 100000% sure she is and am putting his name on the birth certificate whether he likes it or not. I have heard of cases where a DNA test is done if no father is put on the birth certificate but does anyone know how one is done if the father listed on the birth certificate is trying to deny the child?

You cannot put his name on the birth certificate. HE has to put his name on the birth certificate and sign with a notary that he is the father. If he chooses not to do this, that is his choice.

You will NOT pay for any paternity testing, if he is found to be the father, he will pay for the paternity testing. In addition to child support, etc.

He's prob just getting nervous at the fact that he'll be financially resposnible for another human life...for 18 years...

Now that he's denying the baby, get him for all he's got in child support.

You can actually only get up to 1/2 of his income. But that will also be dependent on your own income. You can push for more, but most states have a fee scale they go by on how much parents pay for child support, etc.

Lying about income is hard (unless employed under the table) because they like to see your paystubs and your tax returns. Both of which are definitive about how much money he makes.

If she gets involved with Support Enforcement in her state, they can do this whole process without any fuss from her. Smile

If he isnt at the hospital when she delivers the baby they will ask if she wants to put the father on the birth certificate. I do know that because that was situation with my mom when she had my younger brother. If the father denies the child from there then they will do a paternity test.

They may write his name temporarily, but it won't be permanent. When Oni was born we BOTH had to sign a huge amount of papers for the certificate.

Yes! And the father has to sign LEGALLY with a notary. They don't just put any ol' name in there because you are LEGALLY the father once your name is on the birth certificate.

When you are married the man you are married to is automatically considered the father - even if he isn't. I always thought that was weird, but it is true.

Are you aloud to give the baby his last name if he's not on the birth certificate?

Yes. But you are including your boyfriend on the birth certificate, right? Because he is going to be there and you all are living together and he is supporting you. There would be no reason on earth to leave him off it. Especially for the sake of the child.

I'm just asking. We'll be legally married (HOPEFULLY, stupid SSN card...) by the time the baby's born. Even if we aren't I've already pre-reged at the hospital and they've already put the baby's name down as "Baby Barrick" (his last name).

It seems you have a very lot riding on this ss card. Have you gone back to the social security office and told them you would like your number? This problem could be solved in a matter of mere minutes. Then you could get insurance, get married and have so many of your current issues out of the way.

By the way, pre-registration at the hospital is just pre-registration at the hospital. It has nothing to do with a birth certificate or anything legal.

oh yes, basically everything legal (ID, Marriage, Medicaid) is riding on this stupid card. I'm going tomorrow to try and get the 'temporary' one.

Good. Because this is such a silly stumbling block to everything. I am amazed they didn't give it to you in the first place, considering you told them what you needed it for.

FYI: it is a FEDERAL office so they can't refuse to give you the number and that little receipt that says you applied for and are being mailed the original. All SS offices give this 'temporary' information.

I tried using the receipt they gave me, but because it didn't have my number on it, they couldn't use it. They gave me one all three times (July, lost it. December, still waiting. January, hopefully one will come!)
