I am just curious about something.
My brother is always dating girls who have children and my dad mentioned the other day that if he wasn't careful that he might end up paying child support for those kids.When I asked him what that meant he said that if a man lives with a woman and her kids for 6 months,becomes common law,he is then bound to pay child support.
To me it sounds like the stupidest thing ever,I don't think it's right but I am just curious if anybody here knows the actual legallity of this.

To my knowledge the only way you are bound to pay child support is if the child is biologically yours.

Any input would be great,I have one of those curious minds that needs to know everything about anything that I hear.And I'm guessing from the lack of information on the web(I couldn't find anything anyway)that I am right in assuming that it is false.

uhm im pretty sure he's wrong.. if you live togeather for 6 month he could have to split his and her belongings 50 50,, he has nothing to do with the child though.. UNLESS he adopted one.. if he dosnt have any rights over the kid he then has no reason to pay child support. if he even got married and divorced he shouldnt have to pay because its not his child, biologicaly or legaly,

that is so wrong on so many levels, i common law takes more then 6 monthes, it takes a few years, and the only way he is bound to any child is if her legelly ADOPTS them, otherwise they have to be on the birth certificate or biologically the father

The other girls are right thats not correct... And I"m pretty sure common law is like 7 years here not 6 mo..

Thats one of the dumbest things I've ever heard lol. Every state is different but no ones child ever just becomes 'yours'...you have to have donated the sperm...

thanks guys....I knew it sounded crazy.

I am in canada where(from what I have heard) you are considered common law after 3 years unless you have a child together,if there is a child involved than you are considered common law the day of the birth.

I don't think that a man should have to pay for a child that isn't his unless he has taken responsibility for that child in a court of law. My son is not my dh and if we divorced I would never expect him to pay me child support....that is just absurd!!!

Sarah, I don't think there is a common law here either!! I just didn't say anything because I didn't want anyone to think I was crazy

I believed it to be 1 year before they consider them common law. I have also heard that they changed that to 6 months.

You should look into it.

hey! Its actually once you lived together you are considered common law here, we actually didnt know that and the govt made us pay all this money etc. because we didnt tell them, anyways, you really gotta be careful!

I'm pretty sure in Canada common law is 6 months.

I'm also pretty sure that your father is telling the truth. I know a lady who is getting child support from her sons biological father and her ex husband. I think it's wrong.

wow....they really are changing things around nowadays.
last I heard it was 3 years or if there's a child involved.
I will definately be looking into that,even though my bf and I are considered commonlaw already.We've been together for a couple of years now,and we have a child together.

It really does suck to be classified as common law sometimes though because I filed my income taxes and I qualified for gst rebate and then my bf filed his taxes late and they sent me a letter saying that in lieu of my bf's income tax I no longer qualified and had to repay every penny they gave me.It's such a hassle to have to send the money back!

common law in texas was a year then they changed it to 6 months
