Q: Cobra Question

My wife was terminated in May. Her former employer never sent her the Cobra election forms. Is it too late to request Cobra? Do we have any remedy against her former employer for not sending us the forms? We are in Ohio.

I looked it up at the US department of labor.

The company was required by law to send you the forms within a specified amount of time. I feel it would be difficult for you to fight because the company can easily say they sent you the forms but you or the post office must have lost them. Also, they could argue that if you truly needed Cobra, you would have contacted them or the health insurance company right after you lost coverage and inquired about COBRA. As for a remedy against the former employer, good luck, as it would be hard to prove.

It is probably too late to request COBRA. I would still try everything you can to fight that.

I know there are a few people on here who know more about COBRA than I do.

Thanks for the responses. My original post had an error. She lost her job in October, not May. I think I will just add my wife to my insurance rather than going through Cobra. I cannot believe the added cost to add her through my work. My monthy cost is 5x higher!
