Can I marry a younger man?

im 18 years old and pregnant, but theres one problem my boyfriend is 2 years younger than me. we want to get married so he can give our lil girl his last name, but i think i can get in trouble since i live in california. is there any way we can get married and for me not to get into trouble? some one please help me!

You don't have to be married to give your baby his last name, i'm not married to my boyfriend but our daughter has his last name. Oh and another thing don't type in caps it's annoying

Same with me. My boyfriend and I aren't married but are planning to be in the near future, but when the baby comes it will have his last name.

Exactly, you wouldn't get in trouble.

Is it illegal for a 16 year old to marry an 18 year old in California? I thought that with parental consent marriage of a minor to an adult was fine...

You don`t have to be married to give the baby his last name.
I have a 2 year old and a 2 month and a half year old. i have 2 beautiful boys.Both with same dad. He is 16 and i am 15.
we are getting married on (christmas eve) my 16th birthday.
My children have there fathers last name.

Are you having to go to court to get the judge to agree to this? As far as I've ever known you would need to at your age.

At 17 all that is required is for a parent to sign off. But at 16, I believe you need to petition the court for the legal right to marry and become emancipated.

i live in california and it is tru you do not have to be married to give the baby his last name though personally i think it is a mistake to do so

She's making the entire thing up. So, I wouldn't base anything off her 'experience'.

I know in FL if you are pregnant or have a child you can marry the father of the child as long as you are 16 (or 15?) without parental consent.

I know for a fact, in Washington you cannot get married without petitioning the court system if you are under 17 - period. At 17 you can have your legal guardian sign a waiver that allows you to marry - but before that age, you must go through a judge. You must also have written documents from a pastor, reverend, priest, a counselor and other 'adults' in the community that can attest to your reliability as an 'adult'. Both parties to the marriage are scrutinized - so schooling, employment, legal history - everything will be brought into court to prove your worthiness.

And, this is true even if you are pregnant.
