Can a Woman use Lethal Force to Stop a Rape?

Can she also use lethal force if the rapist is mentally challenged?

If you answered yes to either or both, why? If you answered no to either or both, why not?

Thanks in advance.

Most people agree that if a trespasser is coming into your home, you have a legal right to shoot them. Even a mentally challenged person.

The mental ability of an attacker/intruder has no bearing on the damage they are causing another person. A rape is not a different kind of rape and a home invasion is not a different kind of home invasion depending upon the mental status of the perpetrator.

Now, what would you say to someone if their response to a rape victim who killed her rapist was, "Dear, that man was mentally challenged. He didn't know right from wrong. Why did you kill him? Why couldn't you have just let him finish the rape and live?"

I am not sure where you are going with this? I started to think that you were going to talk about the death penalty- you can't commit someone to death if they are impaired- however it's okay to use lethal force against them- but this is the abortion debate forum so I'm pretty sure you're not headed that route. Very Happy

Anyways, yes, if someone tried to rape me I would use whatever force was at my disposal. You don't know the mental capacities of your attacker, and you certainly don't know the intentions of your attacker-they may rape and then kill you. I will certainly use very violent means to harm the other person -I can, I have the training.

I am considering getting conceal & carry permit, but in that consideration I have to understand that I will shoot someone. No hemming and hawing -if I have a gun, I have to make the decision that I will use it if I have to-which means reconciling shooting someone, and quite possibly killing them.

But I digress...

I agree with you whole heartedly!

You'll see where I'm going with this after we get some more responses. I truly am curious about how others feel about this subject.

I feel that a woman can use lethal force if she is being raped- I'm pefectly comfortable saying that rapists should die.

I do not, however, feel that a mentally ill individual should deserve to die for the same crime, if the mental illness is such that they do not understand the consequences/rules/morality of their actions.

But I don't think a woman should stop and try to figure out the mental capacity of an attacker, in the moment, you defend yourself. But if the illness was really so bad that they didn't understand such basic things, you would probably be able to tell, and perhaps do something about it. Like just knock them over the head or something. I don't know.

If a man tries to rape a woman, the woman has a right to kill him in defense. If it is a mentally impaired man, the woman still has a right to defend herself. Saying she doesn't have a right is like saying shooting a drug addict attacking you is wrong since he is high and doesn't know what his actions are. I think that women should have a right to stop the rapist with lethal force since trying to hit the rapist on the head or something has a large margin for error (I'm a mixed martial artist and I know that holding back or hesitating can REALLY hurt someone when they are in a desparate confrontation). Not only that, women should actively know that they have a right to kill the rapist since if they don't actively know it, they will hesitate when the situation actually arises.

I know that, I'm talking from a philosophical point of view, for example, I am in full support of the insanity plea - and like I said, if that's what you have to do to protect yourself, I'm not expecting women to stop and try to diagnose the attacker.

I don't care if a man is raping a woman or another man, or if a woman is raping a man or another woman. It is one of the most severe violations of personal rights, and any means necessary to prevent this should be employed by the victim, even if the rapist ends up dying. S/he should not have been trying to rape someone.

But why can't the woman just let him finish and be on his way? Does he have to die just so she doesn't have to have sex?
Isn't sex natural? Don't women have vaginas so men can put their penises in them?

Why would I allow someone to violate me and hurt me physically and emotionally just so he could get his rocks off?

You are mistaken if you think rape is about sex. If it were, rapists would just get hookers or use their own hand. It is about control and violence.

So, no, RAPE is not 'natural'. Consentual sex is 'natural'.

Vaginas aren't meant to be plugged by any random guy that walks by.

No he deserves to die, or live his whole life with his penis cut off and blood dripping behind him so everyone knows what he did.

Or if a woman did it, a little more complicated I guess, but something similar....

Sex is natural, between two consenting adults. Penises were made to be accepted into a warm, happy vagina, not forced into a scared, hurt vagina. Have you ever tried to put a penis into one that wasn't lubricated? Lubricant was created to ensure that the woman really wanted to have sex.

i say yes because, and only because at that point and time you have to way to really tell if they are mentally handicapped, but also because i think its just another form of self preservation, would you use lethal force on a handicapped person who was trying to kill you? in the end its all the same question, can you justify it?

All joking aside, though i can't help but crack up and make a fool out of myself in the school library at Georgia's comment about "penises should go in warm welcoming vaginas, not scared hurt ones" after visualizing that. Razz Mentally ill or not, defend yourself. In all honesty, why should somebody (however pitiful their situation may be) that you do not know matter to you enough that you would be willing to risk your purity/peace of mind and happiness. There is a borderline when you are trying to be too good of a person. This person attempting to defile you, however ill may be, should not mean anything to you especially in the moment of being raped. I hardly doubt most people would be calm enough to consider and sympathize the attacker when he is ripping up your clothes and bruising your body.

If someone was attempting to rape/kidnap/harm/kill me, I would do whatever I needed to do to defend myself. I don't think I'd have the presense of mind to stop and administer an IQ test to see if the person was mentally challenged. And to be honest, even if I was pretty sure they WERE mentally challenged, I don't think that would stop me trying to defend myself.

I absolutely wouldn't say "Oh, you have an IQ of 48? Go ahead then."

My body and safety matter too much to me to allow anyone to take advantage without me putting up one hell of a fight.

I agree that a woman has the right to kill anyone who tries to rape her. There is no way to know if the attacker is mentally challenged in the heat of the moment. Any attack should be met with all the force one can muster, regardless of whom the attacker may be. Ingi is correct about the act of rape. It is very much a crime of control and, unfortunately, many times the rapist must kill the victim so she cannot identify him.

Don't know much about threat factors do you? or are you assuming he cannot kill her without a gun or knife? No woman who has ever been raped has been bludgeoned to death? None strangled? Are you being deliberately offensive or just woefully undereducated?

Jinkies I think he was just stressing/emphasizing scenarios where it would be extremely difficult to fight back. The pressure and intensity of rape scenario changes vastly with a weapon at hand. "Don't move and don't try anything or I will bludgeon you to death" and the girl will suddenly stop struggling kind of scenario won't work as effectively, as opposed to a 7 inch rusted knife pricking at her throat or a 9 mm hand gun pointed to her head with the same threat, they would probably stop resistance much quicker. Though I'm not sure if we are talking about the same thing, anyway know what I mean?
