This becomes one of those technical questions.
Technically no matter how shallow you were penetrated, which you say that you aren't a virgin.
However, from your description it sounds like he wasn't able to penetrate you and the head of his penis was just in the entrance of your vagina - in which case you are still a virgin.

Now, technical aside, my opinion on this...
I say, yes, you are a virgin because you were unwilling and so young and full penile penetration did not take place.

Virginity is physical only on a technical level, so while for some women their physical virginity may have been taken from them, they still haven't given their emotional virginity (ie first "normal" sexual encounter) - and that's what counts.

In my opinion, virginity is a totally moral/emotional state of being.

So to me, you are definitely still a virgin because you have not chosen to have sex with another person, and to share that intimacy with another person.

There is nothing on your body that determines if you are technically a virgin or not, so why not just decide yourself?

I think this is an issue which should be brought up in the presence of a qualified counselor or psychologist. A person such as this can answer truthfully and honestly in an unbiased manner free of any judgement some of the difficult questions you have no doubt been unable to ask of other people.

i had exactly the same issue with my ex boyfriend when i was 13, it was unwilling and the same as you he could only get it in less than an inch. i had months of debating with myself after that if i could still call myself a virgin and it was only when i fell in love with my current patner and discovered what loving sex really is that i could convince myself that before him i'd been a virgin. i say ofcourse you are a virgin, i'm really sorry that happened to you, it's not fair and there's no way someone like that could ever take something that special away from you x

It was totally wrong for your uncle to try to have sex with you in the first place, what you should have done was told your parents right away, what is done to you wasn't your fault. The other thing is if he didn't put it all the way in, you are considered still a virgin. I would wait until you get a little more older and find the right man. What you should do is talk to your parents about what your uncle has done. That SOB deserves to be behind bars..

I would consider you to be a virgin.
