child abandonment...there has to be a law

my uncle passed away just recently leaving behind an 11 year old son. The child's mother abandoned them when he was a year old. Now that the father is deceased the mother is coming back to try and gain custody.. there has to be a law restricting her from gaining custody after ten years.we are from alabama.
